I own a flat in a multistoreyed building in Lake Gardens. Built in the 1980s, the building has 14 flats out of which 12 are registered in the name of the owners. We have not formed an association yet and nominate one owner by turn to look after the building’s maintenance.

What should we do to form an association?

All flat owners should come together to form an association and register it with the Registrar of Society. Also consult a property lawyer.

I booked a flat in a highrise complex in Calcutta. I obtained provisional possession about a year ago and started living in the flat. None of the flats has been registered so far. While the promoter said he would soon arrange for registration in groups, he is yet to obtain the completion certificate (CC) from the Calcutta Municipal Corporation.

a) Can flats be registered before obtaining the CC from the corporation?

b) If yes, can mutation with the corporation be done and corporation tax be paid?

c) Does registering the flats before obtaining the CC absolve the promoter of his liability to obtain the certificate?

d) In case there is any deviation from the sanctioned plan, will the responsibility of compliance and the consequent cost still lie with the promoter?

a) Flats can be registered before a CC is obtained.

b) Mutation cannot be done before obtaining the CC as both are executed at the corporation. It is advised that the CC should precede registration, too, as the flat is legally not fit for staying without it.

c) Registering flats does not absolve the developer of the responsibility of obtaining the CC.

d) The promoter has to carry out necessary changes and bear the cost.
